Is it legal to not get paid for the extra hour worked as a result of daylight savings?

They absolutely have to pay you for that hour. Every company that has people working on the 3rd shift knows this and budgets for this. You need to go to your company's HR and if they stonewall you, tell them you'll be filing a complaint with your state's labor department. They're pretty y to even try and get away with that.
